Children should have inalienable rights under the same law. When CPS seizes a child and incarcerates it (whether they are doing it for so-called “protective reasons,” it still amounts to denying a person (and a child is a person whether of voting age or not) their rights and freedoms without due process. A child should be able to have his/hers day in court just like anyone else. If children can be certified as adults in criminal proceedings and retain counsel, then any child should be able to retain counsel and defend his/her rights. The burden of proof should be on CPS to prove otherwise.
